Throughout these Terms, “we”, “us”, and “our” refer to Sold-Trader.

By accessing this website or purchasing from us, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use this website.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a legally binding contract to place an order.

3. Products and Services

We sell essential goods, stationery products, and cosmetic products.

All product descriptions, images, and prices are provided with reasonable care. However:

  • Images are for illustration purposes only.
  • Colours and appearance may vary depending on your device settings.
  • Products are subject to availability.

We reserve the right to withdraw or amend products at any time without notice.

4. Orders and Contract Formation

When you place an order, you are making an offer to purchase goods.

A legally binding contract is formed only when we send written confirmation that your order has been accepted and dispatched.

We reserve the right to refuse or cancel an order where:

  • There is a pricing or description error
  • The product is unavailable
  • Fraud or unauthorised payment is suspected

If payment has already been taken for a cancelled order, a full refund will be issued.

5. Prices and Payment

All prices are displayed in GBP (£) and include VAT where applicable.

Delivery costs are clearly displayed before checkout.

Payment must be made in full at the time of purchase.

6. Delivery

Estimated delivery times are provided at checkout. These are estimates only and are not guaranteed.

In accordance with the Consumer Rights Act 2015, goods remain at our risk until they come into your physical possession.

Ownership of goods transfers to you once full payment has been received.

We are not responsible for delays caused by events outside our reasonable control.

7. Consumer Cancellation Rights (14-Day Cooling-Off Period)

If you are purchasing as a consumer, you have the right under the Consumer Contracts Regulations 2013 to cancel your order within 14 days of receiving the goods.

How to Cancel

You must notify us in writing (email is acceptable) within 14 days of receiving the goods.

Returning Goods

You must return the goods within 14 days of informing us of cancellation.

Unless the goods are faulty or incorrectly supplied, you are responsible for return postage costs.

You may inspect the goods as you would in a physical shop. However, we may reduce your refund to reflect any reduction in value caused by handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

Refunds

We will refund:

  • The full price paid
  • The standard delivery cost (if applicable)

Refunds will be issued within 14 days of receiving the returned goods or receiving evidence that they have been returned, using the original payment method.

8. Faulty or Misdescribed Goods

Your statutory rights under the Consumer Rights Act 2015 are not affected.

Goods must be:

  • Of satisfactory quality
  • Fit for purpose
  • As described

If goods are faulty:

  • Within 30 days of delivery, you may reject them for a full refund.
  • After 30 days (and within 6 months), you are entitled to a repair or replacement.
  • If repair or replacement is not possible or fails, you may be entitled to a refund or price reduction.

We will cover reasonable return costs for faulty or incorrectly supplied goods.

9. Cosmetics & Hygiene Products

9.1 Sealed Cosmetic Products – Cancellation Exception

Under Regulation 28 of the Consumer Contracts Regulations 2013, the right to cancel does not apply to sealed goods which are not suitable for return for health protection or hygiene reasons once they have been unsealed after delivery.

This includes lip gloss and other cosmetic products.

If a sealed cosmetic product has been opened, used, or the hygiene seal broken, it cannot be returned unless the product is faulty or not as described.

9.2 Product Safety & Allergies

All cosmetics sold comply with applicable UK cosmetic safety requirements.

However:

  • Customers are responsible for checking ingredient information before use.
  • If you have sensitive skin, allergies, or medical conditions, we recommend conducting a patch test before full application.
  • We are not responsible for allergic reactions where ingredients are clearly listed and the product has been used correctly.

If you experience irritation, discontinue use immediately and seek medical advice.

This does not affect your statutory rights in relation to unsafe or defective products.

9.3 Cosmetic Use Disclaimer

Our cosmetic products are intended for external use only.

Products must be used in accordance with instructions and for their intended purpose only.

We are not liable for damage caused by misuse, improper storage, alteration of the product, or use contrary to provided instructions.

9.2 Cosmetic Safety & Compliance

All cosmetic products are supplied in compliance with applicable UK cosmetic product safety legislation.

Each cosmetic product is subject to appropriate safety assessment and regulatory requirements.

Nothing in these Terms limits your statutory rights in relation to unsafe or defective products.

9.3 Allergies & Skin Sensitivity

Customers are responsible for reviewing ingredient information prior to use.

If you have sensitive skin, allergies, or medical conditions, you should perform a patch test before full application.

We are not responsible for allergic reactions where:

  • Ingredients are clearly listed; and
  • The product has been used in accordance with instructions.

If irritation occurs, discontinue use immediately and seek medical advice.

9.4 Proper Use

Cosmetic products are for external use only.

We are not liable for damage or injury caused by misuse, improper storage, alteration of the product, or use contrary to instructions.

9.5 Random Scoop & Lucky Ball Products

Certain products (including stationery scoops, essential item lucky balls, and lip gloss scoops) are sold as random selection products.

By purchasing these items, you acknowledge and agree that:

  • Items are selected at random.
  • Specific colours, styles, brands, or designs cannot be guaranteed.
  • Personal preference or dissatisfaction with a random selection does not constitute a fault.

This does not affect your statutory rights where goods are faulty, unsafe, or not as described.

9.6 Product Variations

Packaging and presentation may vary between batches.

Minor variations in colour, finish, or design do not constitute a defect.

If a product is materially different from its description, your statutory rights apply.

10. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Breach of statutory consumer rights
  • Any liability that cannot legally be excluded under UK law

Subject to the above, we shall not be liable for:

  • Indirect or consequential losses
  • Loss of profit, revenue, or business (where you are not purchasing as a consumer)

Our total liability shall not exceed the amount paid for the goods giving rise to the claim.

11. Data Protection

We process personal data in accordance with UK data protection legislation and our Privacy Policy.

12. Force Majeure

We are not responsible for failure or delay in performing our obligations where such failure results from events beyond our reasonable control, including natural disasters, supply chain disruption, industrial disputes, or government action.

13. Governing Law

These Terms are governed by the laws of England and Wales.

If you are a consumer, you may bring legal proceedings in the courts of the part of the United Kingdom in which you reside.
